General terms & Conditions

Thank you for your interest in an activity offered by PMD - CONSULTING.

Please read the following General Terms and Conditions:

Unless expressly agreed otherwise, these General Terms & Conditions apply to all business transactions between PMD - CONSULTING and the customer/client/participant.

The company’s business purpose is the operation of a snow sports, cycling and mountain sports school as well as the placement of mountain guides, hiking guides and paraglider pilots. Ski instructors, snowboard instructors, mountain guides, hiking guides, cycling guides and paraglider pilots will hereinafter generally be referred to as course instructors.

1. Booking

All PMD - CONSULTING activities must be booked in advance. Bookings can be made in writing, over the phone, electronically or in person at PMD – CONSULTING. On booking an activity, the customer acknowledges that these General Terms and Conditions form part of the contract between themselves and PMD - CONSULTING.

Any wishes and concerns regarding dietary requirements and medical needs, etc. must be communicated in advance so that the course instructor can take the appropriate measures.

2. Prices

Prices are quoted in EURO €. Where payments are made in alternative currency such US Dollar $ or Swiss Franc, the service provider’s current exchange rate will be applied. All prices are subject to change.

The prices cover the costs of the lesson, course, or tour. Unless stated otherwise in the detailed quotation, prices do not include food and drink, rental equipment, accommodation costs or transport costs (cable cars and lifts).

3. Payment terms

No contract exists (or booking confirmation) until PMD – CONSULTING receives the payment.
The total amount due for the agreed service must be paid before the activity starts.

4. Cancellation terms

The following cancellation terms apply:

(Skiing, snowboarding, cycling, climbing, hiking, flying, all snow sports)
reimbursement will be calculated as a percentage of the total cost of the subject lessons or courses, as follows:

Cancellation 30 days or more prior to the start of the first lesson: 70%.

Cancellation 15 to 29 days prior to the start of the first lesson: 50%.

Less than 14 days prior to the start of the first lesson: 0%.

The start of the course or activity always refers to the first day of the booked service.
A booked course cannot be postponed to a later date.
Any lesson or group course which is cancelled after it has started will be charged for in full.

No refund is given, in part or in full, by PMD – CONSULTING if:

the activity cannot go ahead due to the late arrival of the customer or the customer failing to show up. Additional costs incurred due to the customer delaying the start of the activity or arriving late will be borne by the customer.
the customer joins an activity after it has begun or stops taking part before it has ended.
the customer does not participate in multi-day bookings for the full number of days.

Unless expressly agreed otherwise, PMD – CONSULTING refunds cancelled reservations using the same method of payment used for the original transaction.

5. Cancellation or order amendments made by PMD - CONSULTING before the activity has started

PMD - CONSULTING reserves the right to amend, cancel or discontinue the programme or individual service after concluding the contract and during the activity itself if natural phenomena and/or weather conditions or other unforeseen circumstances (force majeure, officially imposed measures, safety risks or other risks) make this necessary.
No refund is given, in part or in full, by PMD – CONSULTING.

No refund is given, in part of in full, by PMD - CONSULTING, for activity not taken or unused due to:

late arrival of client,
delays,
illness,
accident,
lifts closed due to weather conditions or mechanical failure,
closure of the lifts/domain for other reasons such as strikes,
any other causes beyond the control of staff of PMD - CONSULTING.

The Instructor has the right to cancel activity or course for personal reason, at any time. In this case, a full refund of the unused activity is accorded by PMD – CONSULTING.

6. Amendments to the programme or discontinuation of an activity after the activity has started

PMD - CONSULTING reserves the right to amend the activity programme or individually agreed service if external factors (e.g. force majeure, weather conditions and natural phenomena, officially imposed measures or safety risks) make this necessary.
No refund is given, in part or in full, by PMD – CONSULTING.

No refund is given, in part or in full, by PMD – CONSULTING, if client taking part in a course:

is not of the required standard and level,
has not provided the correct information at the time of booking,
has changed level since the time of the booking and have not informed PMD – CONSULTING.

Late arrival

The instructor waits, at arranged meeting, point a maximum of:
- 30 minutes for private activity,
- 10 minutes for group activity.
In the event of late arrival leads to a missed lesson no refund is given, in part or in full, by PMD – CONSULTING.

Missed Lessons

No refund is given, in part or in full, by PMD – CONSULTING if client misses lesson/course for whatever reason.

7. Conditions of participation

All participants must be in good health in order to take part in any activity. The participant is obliged to inform PMD - CONSULTING of any health-related concerns. The customer is obliged to strictly follow the instructions issued by the course instructors and assistants. If a participant does not abide by these conditions of participation or fails to follow the instructions issued, PMD - CONSULTING reserves the right to exclude participant from the activity or cancel the activity.
No refund is given, in part or in full, by PMD – CONSULTING.

8. Liability

PMD – CONSULTING does not assume any liability for accidents which occur during lessons, tours, courses, examinations, and competitions. The course instructor cannot guarantee complete safety from the objective dangers in the mountains. The client acknowledges and accepts the inherent residual risks posed by outdoor activities, which are always present despite careful and prudent guidance.
No claims for damages may be made due to errors in illustrations, prices, or texts.

9. Insurance

Most sporting activities have an element of danger and skiing is no exception.

Participant is responsible for arranging its own insurance (health, accident, third party insurance which covers sports accidents). PMD - CONSULTING recommends participants to take cancellation insurance and repatriation insurance too.

Client is encouraged adequate insurance cover is in place to guard against such situations.

10. Claims

PMD - CONSULTING must be notified in writing of any claims or damage incurred, by email (pietro.dalmasso@monaco.mc) within four weeks of the end of the activity. All claims will be null and void if they are submitted late.

11. Images

PMD - CONSULTING reserves the right to use any images for marketing purposes. The customer can withdraw their permission for us to use and share data and images at any time by emailing pietro.dalmasso@monaco.mc. The data we need for our business processes will be treated confidentially.
